Filing 9 EO: On 3/8/2023, pro se Plaintiff Michelle Lindberg ("Plaintiff") filed her [ECF #1 ] Complaint. First, the Court CAUTIONS Plaintiff that it appears the Complaint may fail to comply with Rule 8 of the Federal Rules of Civil Procedure ("Fed. R. Civ. P.") pleading requirements. The rules require that pleadings contain a short and plain statement of the claim showing entitlement to relief. It appears that the Complaint fails to provide fair notice and succinctly state the elements of the claims alleged such that the Court may draw the reasonable inference that the named defendants are liable. Second, the Court CAUTIONS Plaintiff that she is proceeding pro se in this matter and may "appear personally on behalf of [herself] only[.]" LR81.1(a). However, Plaintiff asserts claims on behalf of not only herself, but improperly asserts claims on behalf of "Walton Enterprises, Barak Hussein Obama (Former President of the United States), [and] Manny Reishen[.]" ECF No. 1. Further, "[e]ntities other than individuals, including but not limited to corporations, partnerships, limited liability partnerships or corporations, trusts, community associations, and unions, must be represented by an attorney." LR81.1(b)(emphasis added). Accordingly, Plaintiff may not represent anyone other than herself in this action or assert claims on behalf of other individuals or entities, i.e., Walton Enterprises, Barak Hussein Obama or Manny Reishen.The Court reminds Plaintiff that pro se litigants must abide by all applicable rules of law or "[s]anctions, including but not limited to... dismissal with prejudice may be imposed." LR81.1(a).Further, the Court CAUTIONS Plaintiff that pursuant to Fed. R. Civ. P. 4(m), service of the summons and Complaint must occur within 90 days after the Complaint is filed. Absent a showing of good cause, failure to timely serve defendants may result in sanctions to include possible dismissal of this action.In light of the foregoing, the Telephonic Rule 16 Scheduling Conference scheduled for 5/8/2023 at 9:00 a.m. is CONTINUED to 6/30/2023 at 9:00 a.m. before Magistrate Judge Trader. Scheduling Conference Statements are due 6/23/2023. Parties and other participants must call-in at least five (5) minutes prior to the scheduled start time of the conference.
