MICHAEL SEABRIGHT on 3/31/2023. The court dismisses the Complaint, without prejudice and without leave to amend, because it fails to establish federal subject matter jurisdiction. Plaintiff's claims are dismissed without leave to amend because amendment would be futile. See Barke v. Banks, 25 F.4th 714, 721 (9th Cir. 2022). Further, because the court lacks subject matter jurisdiction, the Complaint is dismissed without prejudice. Id. ("[D]ismissals for lack of Article III jurisdiction must be entered without prejudice because a court that lacks jurisdiction is powerless to reach the merits.") (internal citation and quotation marks omitted). For the foregoing reasons, the court GRANTS Plaintiff's IFP Application, ECF No. 3, but DISMISSES Plaintiff's Complaint, ECF No. 1, without Leave to Amend.
