| Filing 5 EO: On April 18, 2023, the Court ordered Plaintiff to show good cause in writing on or before May 18, 2023 why he is entitled to proceed without prepayment of the full $402.00 filing and administrative fee despite the three strikes that he has accrued pursuant to 28 U.S.C. 1915(g) [ECF No. 3]. On May 5, 2023, the Court received from Plaintiff a document [ECF No. 4] that is clearly intended as his Response to the Court's April 18, 2023 Order. In his Response, Plaintiff asserts that he was recently hospitalized with a staph infection. Plaintiff has not plausibly alleged, however, an "imminent danger of serious physical injury that is both fairly traceable to unlawful conduct alleged in his complaint and redressable by the court." Ray v. Lara, 31 F.4th 692, 701 (9th Cir. 2022). Indeed, Plaintiff fails to allege that his recent medical issue has any connection to the 2018 events described in the Complaint [ECF No. 1]. Thus, this action is DISMISSED without prejudice to Plaintiff raising his claims in a new action with concurrent payment of the civil filing fee. Plaintiff's IFP Application [ECF No. 2] is DENIED as moot. The Clerk SHALL enter judgment and close this case. IT IS SO ORDERED. (CHIEF JUDGE DERRICK K.
