Filing 11 EP:TELEPHONIC RULE 16 SCHEDULING CONFERENCE not held. TELEPHONE CONFERENCE held on 8/7/2023.Discussion had. Parties report [ECF #10 ] Joint Status Report filed on 8/8/2023. Parties confirm instant case similarly situated and requests handling consistent with related case (Mangoba v. Monsanto; 23-cv-00248-HG-RT). Plaintiff to notify the clerk for the Judicial Panel on Multidistrict Litigation ("JPML") of this case and the above-referenced related case (Mangoba) for possible transfer to the Roundup Multidistrict Litigation ("Roundup MDL"). Defendant to oppose transfer as it contends that the inclusion of PCB-related claims exempts this action from the Roundup MDL. Plaintiff disagrees. Parties uncertain as to time frame for JPML to rule on possible transfer to the Roundup MDL. Mr. Melchinger to forward copy of recently issued JPML briefing schedule.In light of the possible transfer to the Roundup MDL, and by agreement of the parties, the Court ORDERS the Clerk's Office to STAY and ADMINISTRATIVELY CLOSE this case. The administrative closure is solely an administrative matter and does not impact, in any manner, any party's rights or obligations, does not alter in any manner any previous rulings by the court, and does not require a filing fee to reopen the case.The administrative closure shall be subject to the following:1.Any party may request the stay be lifted by filing a letter request;2.The closure shall not prevent the parties from submitting, for the Court's approval, a stipulation to dismiss any claim that is resolved/settled;3.If a stipulation to dismiss is submitted to the Court, the Court will direct the Clerk's Office to reopen the case to effectuate the dismissal;4.During the closure period, the parties may jointly request status conferences with the Court as needed;5.Within 10 days of the JPML's determination as to whether this case will be transferred to the Roundup MDL, the parties shall notify the Court; and 6.During the closure period, the Court may convene conferences, assist the parties with settlement discussions or take other action deemed appropriate by the Court.To monitor progress, Court sets Telephone Conference for 12/1/2023 at 9:00 a.m. before Magistrate Judge Trader. Parties to submit brief joint status report by 11/15/2023 regarding Roundup MDL transfer request. Parties and other participants must call-in at least five (5) minutes prior to the scheduled start time of the conference.
