November 20, 2023 Filing 8 EO: On 9/26/2023, Plaintiff David Jarvis ("Plaintiff") initiated this action by filing the [ECF #1 ] Complaint. On 11/13/2023, the Clerk's Office issued the [ECF #7 ] Summons as to Defendants Corteva Agriscience, LLC, and Corteva, Inc. ("Defendants"). The Rule 16 Scheduling Conference is set for 11/27/2023. To date, however, the docket fails to reflect service on Defendants. Moreover, Defendants have not appeared, answered or filed a responsive pleading. Pursuant to Rule 4(m) of the Federal Rules of Civil Procedure, service must occur within 90 days after the complaint is filed. Upon completion of service, the parties are required to confer as soon as practicable, but no less than 21 days before the scheduling conference to discuss specified matters to be included in the planning meeting report filed with the Court. Fed. R. Civ. P. 26(f). In addition, parties are required to file scheduling conference statements at least 7 days prior to the conference. LR16.2(b). Even if service is completed in near future, the parties would have insufficient time to comply with their pre-conference obligations. Accordingly, the Rule 16 Scheduling Conference scheduled for 11/27/2023 is CONTINUED to 12/21/2023 at 8:30 AM before Magistrate Judge Trader. Scheduling Conference Statements are due 12/14/2023.
