Filing 15 EP: TELEPHONIC RULE 16 SCHEDULING CONFERENCE not held / STATUS CONFERENCE held on 11/15/2023.Discussion had. Plaintiff James Barahal ("Plaintiff") condition has largely stabilized, however, further treatment/surgery still may be necessary. Otherwise, Plaintiff has returned to work. Parties agree that a 6-month stay of proceedings appropriate to determine the nature and extent of Plaintiff's injuries and damages. If parties are unable to resolve the case, then parties agree to submit to binding arbitration.Trial date and other scheduling deadlines/hearings not set.By agreement of the parties and for good cause shown, the Court ORDERS the Clerk's Office to ADMINISTRATIVELY CLOSE this case. The administrative closure is solely an administrative matter and does not impact, in any manner, any party's rights or obligations, does not alter in any manner any previous rulings by the court, and does not require a filing fee to reopen the case.The administrative closure shall be subject to the following:1. Any party may file a letter request to reopen the case.2. During the closure period:a. the parties may cooperate and informally exchange medical records/information;b. the parties may jointly request status conferences with the Court as needed;c. the parties may submit, for the Court's approval, a stipulation to dismiss any claim that is resolved/settled;d. if a stipulation to dismiss is submitted, the Court will direct the Clerk's Office to reopen the case to effectuate the dismissal;e. the Court may convene conferences, assist the parties with settlement discussions, and take other action deemed appropriate by the Court; andf. the parties shall file joint status reports every 90 days commencing 12/5/2023.3. Upon the case being reopened, the Court may schedule trial and applicable deadlines.This case shall remain administratively closed through 6/14/2024 or as otherwise ordered by the Court.Court sets Telephone Conference for 6/14/2024 at 8:30 AM before Magistrate Judge Trader.
