October 17, 2023 Filing 6 EO: On 10/12/2023, Plaintiff Kerri Barnes filed an #2 Application to Proceed in District Court without Prepaying Fees or Costs ("Application"). The Court DENIES the Application WITHOUT PREJUDICE because it is incomplete as to Plaintiff's income. For example, under section 2 regarding her current wages, Plaintiff indicates she receives $200 in gross wages (and take-home pay of $170) but fails to specify the applicable pay period (e.g., yearly, monthly, weekly, etc.) or even provide a range of dates as to when she earned these wages, and instead lists only a single date (10/13/2023), which is also a date after she filed her Complaint. Plaintiff also failed to list the employer's name and address for these current wages. In addition, although in section 3 Plaintiff indicated that she recently accepted a new job subject to a background check being approved, she did not identify the new employer or her anticipated wages for that new job. Based on the allegations in the Complaint, Plaintiff's wages in the past 12 months and her expected future wages will likely be determinative of whether she can afford to pay the filing fee for this case. See ECF No. 1 at 4 ("I kindly request five years' worth of my yearly salary, amounting to 300k"). The Court therefore DIRECTS Plaintiff to file a new Application that clearly indicates: the total amount of wages Plaintiff earned in the past 12 months, if any, and from what sources; Plaintiff's current employer and more detail regarding the amount of wages she currently earns (e.g., on a weekly, monthly, or yearly basis); and the name of the employer Plaintiff has recently accepted a job with, when she will be notified regarding the outcome of her background check for that job, and her anticipated wages for that job (e.g., on a weekly, monthly, or yearly basis). Plaintiff's renewed application should be filed by no later than 10/30/2023. The Clerk's Office is directed to provide Plaintiff a blank Application form (AO 240) with this Entering Order.
