March 7, 2024 Filing 10 EO: On March 6, 2024, prior to the entry of a final order in this case, Plaintiff Ronald Emrit filed a notice of appeal. Dkt. No. #9 . Liberally construing the notice of appeal and the record generally, it appears that Plaintiff seeks to appeal the assigned Magistrate Judge's Findings and Recommendation (F&R) to, among other things, dismiss this case without prejudice. The F&R, however, is not a final, appealable order. See Collins v. Smith, 2024 WL 130121, at *1 (C.D. Cal. Jan. 11, 2024) (citing United States v. Hickey, 580 F.3d 922, 928 (9th Cir. 2009)).
