Filing 7 EO: The Court is in receipt of Plaintiff Paul Gantt's #6 letter requesting "more time to put all of [his] 8 civil cases together and mail them all at the same time." See ECF No. #6 . Mr. Gantt also requests that pro bono counsel be appointed. See id. The Court DENIES Mr. Gantt's general request for more time to put his case together. "[P]ro se litigants in the ordinary civil case should not be treated more favorably than parties with attorneys of record." Jacobsen v. Filler, 790 F.2d 1362, 1364 (9th Cir. 1986). As a pro se litigant, Mr. Gantt is not exempt from compliance with the Federal Rules of Civil Procedure, Local Rules, or the orders of this Court. See Local Rule 81.1(a) ("Pro se litigants shall abide by all local, federal, and other applicable rules and/or statutes."). The Federal Rules of Civil Procedure and other applicable rules or statutes govern the timing of this case. Accordingly, Mr. Gantt's general request for more time to put his case together is DENIED. To the extent Mr. Gantt requests additional time in relation to specific deadlines, any such request will be considered when it is received. Additionally, the Court DENIES Plaintiff Paul Gantt's request for pro bono counsel. Generally, a civil litigant has no right to counsel. See Palmer v. Valdez, 560 F.3d 965, 970 (9th Cir. 2009). "However, a court may under 'exceptional circumstances' appoint counsel for indigent civil litigants pursuant to 28 U.S.C. 1915(e)(1)." Id. (citing Agyeman v. Corr. Corp. of Am., 390 F.3d 1101, 1103 (9th Cir. 2004)). In determining whether "exceptional circumstances" exist, courts consider "the likelihood of success on the merits as well as the ability of the [plaintiff] to articulate his claims pro se in light of the complexity of the legal issues involved." Id. (quoting Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983)). Here, Mr. Gantt has not addressed the applicable standard set forth above to warrant the appointment of pro bono counsel in this case. Additionally, Mr. Gantt has not demonstrated in forma pauperis status and, therefore, he is not eligible for court-appointed pro bono counsel under Section 1915(e)(1). See Hopkins v. Rsch. Corp. of Univ. of Hawaii, No. CV 19-00054 JMS-KJM, 2019 WL 1292290, at *2 (D. Haw. Mar. 20, 2019) (denying motion for appointment of counsel based on this factor alone).
