| Filing 28 EO: On December 29, 2025, Plaintiff Carmela Lynn Jackson-Lewis filed a pro se Complaint and application to proceed in forma pauperis ("IFP Application"). Dkt. Nos. #1 & #3 . On January 20, 2026, the Court issued an Order dismissing the Complaint with leave to amend and denying the IFP Application as moot. Dkt. No. #11 . Therein, the Court informed Jackson-Lewis that she had until February 3, 2026 to file an amended complaint curing the pleading deficiencies identified by the Court; failure to follow these instructions would result in the automatic dismissal of this action. Id. at 5. Following the Court's Order, Jackson-Lewis has filed a series of "Exhibits" in support of the dismissed Complaint, consisting of handwritten notes, printed websites, random receipts, and other ramblings. Dkt. Nos. 12-16, 17-23, 24-25. None of these purported Exhibits acknowledge the Court's January 20 Order or claim to be an amended complaint, and each was filed without any explanation as to their relevance. One Exhibit contains a completed IFP Application form and a Social Security Administration complaint. See Dkt. No. #14 . To the extent that Jackson-Lewis intends this to serve as an amended complaint, she merely repeats the same confused allegations provided in her initial Complaint and therefore fails to comply with the Court's order to cure the identified deficiencies. Federal courts have the authority to dismiss cases sua sponte for failure to prosecute or failure to comply with court orders. See Fed. R. Civ. P. 41(b); Link v. Wabash R.R. Co., 370 U.S. 626, 630 31 (1962). In doing so, the Court must weigh five factors: "(1) the public's interest in expeditious resolution of litigation; (2) the court's need to manage its docket; (3) the risk of prejudice to defendants/respondents; (4) the availability of less drastic alternatives; and (5) the public policy favoring disposition of cases on their merits." Pagtalunan v. Galaza, 291 F.3d 639, 642 (9th Cir. 2002) (citing Ferdik v. Bonzelet, 963 F.2d 1258, 126061 (9th Cir. 1992)). Here, the Court finds that the relevant factors support dismissal of this case. The public's interest in expeditious resolution of this litigation strongly favors dismissal, as does the Court's need to manage its docket. See id.; Yourish v. California Amplifier, 191 F.3d 983, 990 (9th Cir. 1999). Moreover, allowing this action to sit idle would prejudice Defendants. See Yourish, 191 F.3d at 991-92 (finding risk of prejudice to defendants where plaintiffs unreasonably delayed their response to the judge's order). Finally, the Court has already provided Jackson-Lewis with less drastic alternatives to no avail. See Ferdik, 963 F.2d at 1262 (explaining "a district court's warning to a party that his failure to obey the court's order will result in dismissal can satisfy the 'consideration of alternatives' requirement."). Although the Court recognizes that the public policy favoring disposition of cases on their merits weighs against dismissal, this factor does not outweigh the other four factors which favor dismissal. See Malone v. U.S. Postal Serv., 833 F.2d 128, 133 n.2 (9th Cir. 1987). Accordingly, this case is DISMISSED WITHOUT PREJUDICE for failure to file an amended complaint in compliance with the Court's January 20, 2026 Order. The Clerk is directed to CLOSE this case. Although the Court has serious doubts that amendment would cure any of the above defects, it is obliged to DISMISS the Complaint without prejudice and with leave to amend. Plaintiff may have until February 3, 2026 to file an amended complaint consistent with a litigant's ethical obligations under Fed.R.Civ.P. 11(b).
