Filing 96 ORDER: Count I: The Funds have proven their case against S&S. Judgment is therefore entered in favor of Plaintiffs and against S&S on Count I in the amount of $56,386.39 plus attorneys fees. Counsel is directed to submit an affidavit of fees wit h supporting documentation within 14 days. Defendant may respond to the attorney fee calculation and documentation within 14 days thereafter. Count II: The Funds have failed to prove that Helen Struben breached her fiduciary duty. Judgment is therefo re entered in favor of Helen Struben and against Plaintiffs on Count II. Count III: I find that Helen Struben was an alter ego for S&S. Judgement is therefore enteredin favor of Plaintiffs and against Helen Struben on Count III in the amount of $ ;56,386.39. Count IV: I find that FPI and S&S were not a single employer. Judgment is therefore entered in favor of the FPI and against the Plaintiffs.Count V: I find that FPI was not an alter ego of S&S.
