[d/e 88] a)Attorneys fees are awarded in the amount of $3,750.00. b)Pursuant to 42 U.S.C § 1997e(d)(2), the court applies 1% of the the plaintiff's judgment, or $37.50, to satisfy the attorneys' fees awarded in subparagraph (a) above. The balance of attorneys' fees ($3,712.50) is assessed against the d efendant. 2)Costs under 28 U.S.C. § 1920 are awarded to the plaintiff and taxed against the defendant against whom judgment was entered in the amount of $5040.04. 3) The court will also award the costs of copying documents. The plaintiff m ust provide information concerning which costs were for additional copies due to multiple attorneys representing the plaintiff, and which copies were for discovery, court motions and trial. Based on the additional briefing provided, the court will grant summary judgement p ursuant to Fed. R. Civ. P. 56 on the plaintiff's claim that Defendants Grove and Hoffmeyer committed the state law offense of intentional infliction of emotional distress. The surviving five claims outlined in this order will proceed to bench tr ial. 3. The clerk of the court is directed to dismiss Defendants Hoffmeyer, Bentley and Hurley as there are no surviving claims against these defendants. See September 8, 2008 Court Order. 4.
