Filing 56 ORDER granting in part and denying in part 50 Motion for Summary Judgment. CCourt grants Defendants' motion as to Plaintiff's equal protection claims. Accordingly, Counts II and III of the Amended Complaint are dismissed. The Court, howev er, denies summary judgment to Defendants on the claims of trespass and false imprisonment. Because the trespass and false imprisonment claims, alleged in Counts IV and V, respectively, are the only claimsthat remain in this case, and because these c laims are based on state common law, Counts IV and V of the Amended Complaint are hereby DISMISSED WITHOUTPREJUDICE.
