The Officers' 37 Motion for Summary Judgment is GRANTED as to IHCA charge against Officer Dearing only, and is DENIED as to all other counts against the Defendant-Officers. The Co unty and Sheriff McCoy's 38 Motion for Summary Judgment is GRANTED on the issue of liability resulting from the IHCA charge against Officer Dearing only, and is DENIED as to all other claims against Peoria County and Sheriff McCoy. Both Plain tiff's and Defendant's 44 and 46 Motions for Sanctions are DENIED. Additionally, the Final Pretrial Conference is rescheduled to December 3, 2009 at 2:30 p.m.(parties will meet with Judge McDade's law clerk at 1:30 p.m. on that date), and the Jury Trial is rescheduled to January 11, 2010 at 9:00 a.m. both in Courtroom D in Peoria before Judge Joe Billy McDade.(FDT, ilcd)
