Based on the foregoing, the Court grants Defendant Engle's Motion to Dismiss 22 is GRANTED IN PART and DENIED IN PART; it is granted as to Count II and denied as to Counts I and IV. The Motio n to Dismiss by BPD, Siron, and Wikoff 24 is GRANTED, and Count III is DISMISSED. Defendants BPD, Siron, and Wikoff are hereby terminated as parties to this matter.
