ORDER & OPINION granting 2 Plaintiff's Motion for Leave to Proceed in forma pauperis. Plaintiff's claim against Secretary White under 42 USC Section 1983 is untimely. Plaintiff's claim against Judge Yoder is barred by the Heck doctri ne. Furthermore, Judge Yoder has absolute immunity for judicial decisions made during Plaintiff's criminal proceedings.
