MERIT REVIEW OPINION entered by Judge Sue E. Myerscough on 6/11/2018. Pursuant to its merit review of the Complaint under 28 U.S.C. § 1915A, the Court finds that the Plaintiff states plausible constitutional claims for excessive force, failure to intervene, failure to provide medical attention and retaliation. The Defendants implicated in one or more of these claims are defendants Smith, Davis and Thorson. Defendants Blackard, Cox, Melvin, Kennedy and Ruskin are dismissed without prejudi ce and terminated from the case. The Plaintiff's motion for the Court to appoint counsel is denied, d/e 5 , with leave to renew after the Plaintiff demonstrates that he has made reasonable efforts to find counsel on his own.
