TEXT ORDER: Petitioner Emonte D. Kohl has filed a Petition for a Writ of Habeas Corpus Under 28 U.S.C. 2241 #1 . In the petition, Petitioner alleges that his state sentence and incarceration in violation of the Constitution. The Court hereby gives notice that it intends to convert Petitioner's 2241 petition into a petition for a writ of habeas corpus under 28 U.S.C. 2254. The Court hereby warns Petitioner that this recharacterization would mean that any subsequently filed 2254 petition would be subject to the limitations on second or successive motions set forth in 28 U.S.C. 2244(b). Defendant has until Friday, October 26, 2018, to (1) object to the proposed recharacterization, (2) withdraw the filing, or (3) amend the filing. If Petitioner does not respond in the allotted time, this Court will recharacterize the filing and analyze it under 2254. The Clerk is DIRECTED to send Petitioner a 2254 packet.
