September 7, 2018 Opinion or Order TEXT ORDER granting #4 the Plaintiff's Motion to Transfer Venue to the Springfield Division of the Unites States District Court for the Central District of Illinois. The Plaintiff is directed to file a further amended complaint within 14 days that adequately alleges the factual basis for this Court's jurisdiction based upon diversity. The First Amended Complaint [4-1] attached to the Motion to Transfer alleges, "upon information and belief," Eric A. Smith is a "resident" of Florida. However, the citizenship of an individual is based upon domicile, not on residence. America's Best Inns, Inc. v. Best Inns of Abilene, L.P., 980 F.2d 1072, 1074 (7th Cir. 1992). Also, asserting jurisdiction on the basis of information and belief is insufficient to invoke diversity jurisdiction. See id. ("to the best of my knowledge and belief" is insufficient to invoke diversity jurisdiction); Page v. Wright, 116 F.2d 449, 451 (7th Cir. 1940) (expressing serious doubts as to whether the record could be sustained in the face of a direct jurisdictional attack where diversity jurisdiction was asserted, in part, based upon information and belief).
