TEXT ORDER: DENYING #4 , Petitioner's Motion to Request Counsel. Although Petitioner has no absolute right to counsel in a civil proceeding, See Merritt v. Faulkner, 697 F.2d 761, 763 (7th Cir. 1983), he asks the Court to exercise its discretion to appoint counsel. After considering the factors set forth in Merritt, the Court concludes that appointment of counsel is not warranted in this action at this time. He has neither demonstrated that he made a reasonable attempt to retain private counsel nor alleged any physical or mental disability which might preclude him from adequately investigating the facts giving rise to his Petition. TEXT ORDER: DENYING #2 Petitioner's Motion for Leave to proceed in forma pauperis. The Petitioner has completed the short form, AO 240, indicating that he has no income, no savings, no debts, and no assets. He has also filed a copy of his Prisoner Trust Fund Ledger detailing his income for the last year. (D. #3 ). According to the ledger, however, the Petitioner can afford to pay the $5 filing fee in this case. Therefore, the Petitioner's Motion is DENIED. The Petitioner has twenty one (21) days (by 9/26/18) to pay the filing fee or this action will be dismissed for failure to prosecute.
