November 13, 2018 Opinion or Order TEXT ORDER DISMISSING THE CASE. On September 27, 2018 this Court dismissed Plaintiff's complaint, partially with prejudice and partially without, on merit review pursuant to 28 U.S.C. 1915A. (Doc. 4). The Court allowed Plaintiff 30 days from that date to file an amended complaint, warning that the case would be dismissed if he failed to do so. That deadline passed on 10/29/2018. Fed. R. Civ. P. 6(a)(1)(C). The Court has not received any filings from Plaintiff. Therefore, the case is DISMISSED WITH PREJUDICE due to failure to prosecute. Case Terminated. September 27, 2018 Opinion or Order Filing 4 ORDER & OPINION entered by Judge Joe Billy McDade on 9/27/2018. For the reasons stated, Plaintiffs Complaint is DISMISSED. IT IS ORDERED that because Defendant Giraudo is entitled to absolute immunity, the claims against him are DISMISSED WITH PREJUDICE. The claims against Defendants Catton, the East Peoria Police Department, and the Tazewell County States Attorneys Officeare DISMISSED WITHOUT PREJUDICE. Plaintiff MAY file an amended complaint which states a cause of action against only those defendants who are not entitled to absolute immunity within thirty (30) days from the date of this order. September 27, 2018 Opinion or Order ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $28.93. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. If Plaintiff has no means to pay the initial partial filing fee, it is not to be exacted. 28 U.S.C. Section 1915(b)(4). After payment of the initial partial filing fee, or immediately if no funds are available for that payment, the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of Plaintiff shall forward these payments each time Plaintiff's account exceeds $10 until the filing fee of $350 is paid in full. The Clerk is requested to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office. Entered by Judge Joe Billy McDade on 09/27/2018. (JR, ilcd)
