Filing 4 +++ PRISONER TRUST FUND LEDGER. (SAG, ilcd) |
Set/Reset Deadlines: Amended Pleadings due by 10/17/2018. (FDS, ilcd) |
TEXT ONLY ORDER: Plaintiff has filed a complaint #1 that is largely unreadable. The Court therefore directs Plaintiff to file an amended complaint that is legible within 14 days of this Order. The Court notes that Plaintiff has checked the box on the complaint form indicating that he has not brought any other lawsuit in state or federal court dealing with the same facts involved in this case. Although his complaint is largely illegible, the Court notes that it can decipher the first line of his claim, which starts with the date of September 21, 2013. That is the same date alleged in Plaintiffs prior case in this district, and appears to be against the same defendants. If the Court finds that the allegations in Plaintiffs re-filed complaint are in fact an attempt to relitigate the dismissal of Plaintiffs prior lawsuit in this district, Case No. 17-1561, the Court will summarily dismiss this action with prejudice and assess a strike against Plaintiff for filing a frivolous or malicious lawsuit. See 28 U.S.C. 1915(g). If no amended complaint is filed within 14 days of this order, this case will be dismissed for failure to prosecute. Entered by Chief Judge James E. Shadid on 10/3/2018.
