TEXT ORDER: On 10/31/2018, the Court entered an order to show cause why this case should not be transferred to the Springfield Division of the U.S. District Court for the Central District of Illinois. The Complaint alleges that a substantial number of the acts giving rise to the insurance claim which forms the basis of this action occurred in the Central District of Illinois and further alleges the homeowners insurance policy at issue identifies a location in Quincy, Illinois which is in Adams County, Illinois. In response to the order to show cause, the Plaintiff's counsel apologizes for the oversite resulting in selection of the wrong division of the Court and requests this Court transfer this matter to the Springfield Division of the Central District of Illinois. The Clerk is accordingly directed to TRANSFER this case to the Springfield Division of the U.S. District Court for the Central District of Illinois. See 28 U.S.C. 1404(a) ("For the convenience of parties and witnesses, in the interest of justice, a district court may transfer any civil action to any other district or division where it might have been brought...."). TEXT ORDER: The Plaintiff's Complaint #1 alleges that venue is proper in this district pursuant to 28 U.S.C. 1391(b)(2) "because a substantial number of the acts giving rise to the insurance claim which forms the basis of this action, i.e., purchase and formation of the insurance contract at issue, occurred in the Central District of Illinois." Local Rule 40.1 provides the divisions of the U.S. District Court for the Central District of Illinois in which complaints and subsequent filings will be filed. See Local Rule 40.1(A)-(D). The Complaint further alleges the homeowners insurance policy at issue identifies a location in Quincy, Illinois. Quincy, Illinois is in Adams County which is in the Springfield Division. The Complaint does not state, as part of the statement of jurisdiction, the basis for filing in the Peoria Division. See Local Rule 40.1(F). In light of all this, the Plaintiff is ordered to show cause in writing, by 11/7/2018, why this case should not be transferred to the Springfield Division of the U.S. District Court for the Central District of Illinois.
