TEXT ORDER: DENYING #10 , #11 , #12 , and #13 , Plaintiffs' individual Motions to Request Counsel. Although Plaintiffs have no absolute right to counsel in a civil proceeding, See Merritt v. Faulkner, 697 F.2d 761, 763 (7th Cir. 1983) and Pruitt v. Mote, 503 F. 3d 647, 654 (7th Cir. 2007), they ask the Court to exercise its discretion to appoint counsel for them. After considering the factors set forth in Merritt, the Court concludes that appointment of counsel is not warranted in this action at this time. The Plaintiffs have neither demonstrated that they made a reasonable attempt to retain private counsel nor alleged they have any physical or mental disability which might preclude any of them from adequately investigating the facts giving rise to their Complaint. See Merritt, 697 F.2d at 765. Accordingly, the Plaintiffs' Motions to Request Counsel are DENIED. After making sufficient attempts to retain private counsel, the Plaintiffs may make another request for appointed counsel. They will be required, however, to attach documentation proving (1) that they have made sufficient attempts to retain private counsel and (2) they are mentally or physically incapable of investigating the facts giving rise to their Complaint. TEXT ORDER: DENYING #6 , #7 , #8 , and #9 , Plaintiffs' second individual Motions for Leave to proceed in forma pauperis. The Plaintiffs have completed the long forms, AO 239, indicating their income, savings, debts, and assets. According to these forms, the Plaintiffs collectively earn enough income to afford to pay one filing fee in this case. Therefore, the Plaintiffs' Motions are DENIED. The Plaintiffs have twenty one (21) days (by 12/26/18) to pay the filing fee in this matter. Otherwise, this action will be dismissed for failure to prosecute. The Plaintiffs are also cautioned that #1 their Complaint does not adequately state a short and plain statement of their claim showing that they are entitled to relief, as required by Federal Rule of Civil Procedure 8. In other words, the Plaintiffs need to at least concisely explain how the Defendant did or did not violate the law in their Complaint. In the event that they choose to pay the filing fee and proceed with this matter, the Plaintiffs must file an Amended Complaint.
