December 11, 2018 Opinion or Order Filing 5 ORDER entered by Judge Joe Billy McDade on 12/11/2018. IT IS THEREFORE ORDERED:1. This case shall proceed as alleged against Defendants Taylor and Sedowski intheir individual capacities; the claims against Defendants Taylor and Sedowski in their official capacities are DISMISSED WITH PREJUDICE. The claims againstDefendants City of Washington and Tazwell County Sheriff's Department are DISMISSED WITHOUT PREJUDICE for failure to state a claim upon which relief may be granted; Plaintiff may file an amended complaint alleging plausible Monell claims against Defendants City of Washington and Tazwell County Sheriff's Department on or before January 7, 2019. Plaintiff is advised that any amended complaint must contain all his claims in this suit, including the claims he has already stated against Defendants Taylor and Sedowski, individually. The amended complaint would take the place of the original Complaint (Doc. 1); Plaintiff may not simply incorporate by reference the claims stated in the original Complaint. Plaintiff is further advised that additional claims not raised in the original Complaint will not be considered in this case except in the Court's discretion upon motion by a party for good cause shown or by leave of the Court pursuant to Federal Rule of Civil Procedure 15.2. The Clerk is directed to, pursuant to this District's internal procedures, send each Defendant: (1) a Notice of Lawsuit and Request for Waiver of Service, (2) a Waiver of Service, (3) a copy of the Complaint, and (4) a copy of this Order. 3. If a Defendant fails to return a signed Waiver of Service to the Clerk within thirty (30) days after the Waiver is sent, the Clerk shall take appropriate steps to effect formal service on that Defendant and that Defendant shall pay the full cost of formal service pursuant to Federal Rule of Civil Procedure 4(d)(2). If a Defendant no longer works at the address provided by Plaintiff, the entity for which the Defendant worked at the time identified in the Complaint shall provide the Clerk with the Defendant's current work address or, if unknown, the Defendant's forwarding address. This information will be used only to effect service. Documentation of forwarding addresses will be maintained only by the Clerk and shall not be maintained in the public docket or otherwise disclosed by the Clerk. 4. Defendants shall file an answer in accordance with the Local Rules. A motion to dismiss is not an answer. The answer shall include all appropriate defenses. 5. Plaintiff shall serve upon any Defendant who has been served, but who is not represented by counsel, a copy of every further filing submitted by Plaintiff for consideration by the Court and shall also file a certificate of service stating the date on which the copy was mailed. Any paper received by a District Judge or Magistrate Judge that has not been filed with the Clerk or that fails to include a required certificate of service will be stricken by the Court. 6. Once counsel has appeared for a Defendant, Plaintiff need not send copies of filings to that Defendant or to that Defendant's counsel. Instead, the Clerk will file Plaintiff's document electronically and send notice of electronic filing to defense counsel. The notice of electronic filing shall constitute notice to the Defendant pursuant to CDIL-LR 5.3. If electronic service on a Defendant is not available, Plaintiff will be notified and instructed accordingly. 7. Plaintiff shall immediately notice the Court of any change in mailing address or phone number. 8. The Clerk is directed to enter scheduling deadlines and to set an internal court deadline of sixty (60) days from the entry of this Order for the Court to check on the status of service. December 6, 2018 Opinion or Order TEXT ORDER granting #2 Motion for Leave to Proceed in forma pauperis entered by Judge Joe Billy McDade on 12/6/2018. Pursuant to 28 U.S.C. 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $32. As of November 23, 2018, Plaintiff had sufficient funds to pay the initial partial filing fee. If Plaintiff's balance remains in excess of $32, the agency having custody of Plaintiff is directed to forward payment of the $32 fee to the Clerk of Court. However, if Plaintiff's balance is now below $32, the initial partial filing fee shall be waived pursuant to 28 U.S.C. 1915(b)(4). See also Bruce v. Samuels, 136 S. Ct. 627, 629 (2016). In either event, the agency having custody of Plaintiff is hereafter directed to make monthly payments of 20% of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of Plaintiff shall forward these payments each time Plaintiff`s account exceeds $10 until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this Order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office. (EWL, ilcd)
