Filing 11 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 4/15/2019. IT IS THEREFORE ORDERED:1) Plaintiff's amended complaint is dismissed. Plaintiff will not be allowed to proceed with a class action, some of Plaintiff's claims are barred by the two-year statute of limitations period, and his complaint is a violation of Rule 8 of the Federal Rules of Civil Procedure. 2) Plaintiff may file a second amended complaint within 21 days or this order or on or before May 6, 2019 clarifying his claims and Defendants. If Plaintiff fails to file his second amended complaint on or before May 6, 2019, or fails to follow the Court's specific instructions, his case will be dismissed without prejudice. 3) Plaintiff's motion for appointment of counsel is denied with leave to renew after he clarifies his claims. #5 Plaintiff's motion for a status update is also denied as moot. #10 4) Plaintiff's motion to notify the Court that he will be requesting punitive damages is also denied as moot. #9 Plaintiff must clarify his claims in a second amended complaint. 5) The Clerk of the Court is directed to send Plaintiff a blank complaint form to assist him and to set a revised internal merit review deadline within 21 days of this order. TEXT ORDER entered by Judge Colin Stirling Bruce on 2/22/2019. Plaintiff filed his complaint, motion to proceed IFP, and motion for appointment of counsel on February 15, 2019. Plaintiff has now filed a motion to amend stating he forgot to sign his complaint, and therefore he has provided another, signed copy #6 . Unfortunately, Plaintiff also included a second copy of his motion for counsel and motion to proceed IFP. The Court does not need a second copy of the motions particularly since Plaintiff's IFP motion has been granted. See February 15, 2019 Text Order. The motion is granted #6 . TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $47.11. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full.
