May 16, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 5/16/2019. On April 11, 2019, the Court denied Plaintiff's motion for leave to proceed in forma pauperis in this case. Therein, the Court explained that Plaintiff's release from the IDOC may have an affect upon his request for leave to proceed in forma pauperis. Accordingly, the Court gave Plaintiff twenty-one (21) days from the date of the Court's Order either to pay the filing fee or to move again for leave to proceed in forma pauperis, and the Court provided Plaintiff with the appropriate forms to re-file his motion for leave to proceed in forma pauperis if that was his desire to do so. As of today, Plaintiff has neither paid the filing fee nor moved again for leave to proceed in forma pauperis. As a result, this case is dismissed, without prejudice, based upon Plaintiff's failure to comply with the Court's order by either paying the filing fee or moving for leave to proceed in forma paupers. This case is closed. No judgment to enter.(JMB, ilcd)
April 11, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 4/11/2019. Plaintiff's motion for leave to proceed in forma pauperis #3 is DENIED with leave to re-file. Plaintiff indicated on his petition to proceed in forma pauperis that he was incarcerated. However, Plaintiff has since been released from the IDOC's custody. Plaintiff's release may have an affect on his request to proceed in forma pauperis. Accordingly, the Clerk of the Court is directed to send the appropriate form with which Plaintiff may move for in forma pauperis status. Plaintiff should complete this form accurately and truthfully and return the petition to the Court within twenty-one (21) days from the date of this Order. Plaintiff's failure to return this form or pay the filing fee within this time frame will result in the Court dismissing this case. (JMB, ilcd)
April 11, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 4/11/2019. Plaintiff's motion for counsel #5 is DENIED. The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after conducting a merit review of the complaint. In addition, Plaintiff is no longer in custody, and therefore, incarceration does not hamper his ability either to litigate this case or to find counsel on his own. (JMB, ilcd)
