TEXT ORDER: The Court is in receipt of #8 , the Plaintiff's Amended Complaint, dated 5/6/2019. On 4/30/2019, the Court entered an order determining that the Plaintiff's Petition to Proceed in forma pauperis was denied and his Complaint was dismissed. (D. #6 ). On 5/1/2019, judgment against the Plaintiff was entered and the Court further informed him that pursuant to Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997), the payment method specified in 28 U.S.C. 1915(b)(1) applies to any prisoner who seeks to proceed in forma pauperis, whether or not such status is granted. TEXT ORDER: On 4/30/2019, the Court entered an order determining that the Plaintiff's Petition to Proceed in forma pauperis was denied. (D. #6 ). Pursuant to Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997), the payment method specified in 28 U.S.C. 1915(b)(1) applies to any prisoner who seeks to proceed in forma pauperis, whether or not such status is granted. Therefore, the agency having custody of the Plaintiff is directed to remit the filing fee of $400.00 from his prison account if such funds are available. If he does not have $400.00 in his account, the agency is directed to make monthly payments of 20 percent of the preceding month's income credited to the Plaintiff's account to the Clerk of the Court. Income includes all deposits from any source. The agency having custody of the Plaintiff shall forward these payments each time the Plaintiff's account exceeds $10, until the filing fee is paid in full. The Clerk is directed to mail a copy of this order to the Plaintiff's place of confinement, to the attention of the Trust Fund Office. Entered by Senior Judge Michael M. Mihm on 5/1/2019.
