June 4, 2019 Opinion or Order TEXT ORDER: Petitioner has filed a hybrid petition (Doc. #1 ) pursuant to both 28 U.S.C. 2255 and 2241. Petitioner claims that he found an error in his presentence report "that led to a high, incorrect, sentencing range" in his sentence and that his sentence is void because the sentencing judge had a conflict, which are properly brought in a 2255 motion. He also claims that the Bureau of Prisons is refusing to give him credit for time served on his state court convictions, which is properly brought under 2241. See Romandine v. United States, 206 F.3d 731, 736 (7th Cir. 2000) (holding challenges to the BOP's sentencing calculation are properly brought in a 2241 petition). Petitioner initially filed this matter in the District Court for the District of Central California and that court transferred the matter here. As Petitioner is incarcerated in this district, his 2241 claims are properly brought here and can be addressed by this Court. See Rumsfield v. Padilla, 542 U.S. 426, 434 (2004). His 2255 claim is properly brought in this district as well, as the sentence Petitioner challenges was imposed in this district, but should be before the judge which imposed his sentence, Judge James Shadid. See 28 U.S.C. 2255(a) (A prisoner "may move the court which imposed the sentence to vacate, set aside or correct the sentence"); Rule 4(a) of the Rules Governing Section 2255 Proceedings for the United States District Courts ("The clerk must promptly forward the motion to the judge who conducted the trial and imposed sentence"). Since Petitioner chose to file a hybrid petition, the Court will transfer the entire matter to Judge Shadid, who can preside over all of the claims. Accordingly, the Court DIRECTS the Clerk to transfer this matter to Judge Shadid and file it in accordance with the procedures under Rule 3 of the Rules Governing Section 2255 Proceedings for the United States District Courts.
