TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Plaintiff's trust fund ledgers indicate he has no funds to make an initial partial payment of the filing fee. Pursuant to 28 U.S.C. Section 1915(b)(4), the initial partial filing fee is waived. The agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. TEXT ORDER entered by Judge Colin Stirling Bruce on 6/20/2019. Plaintiff, a pro se prisoner, has filed a complaint pursuant to 42 U.S.C. 1983 alleging an officer sexually harassed him on April 24, 2019 when the officer told Plaintiff's cell mate to return to their cell. Plaintiff said he was using the toilet and had a sign on his door stating "Do No Disturb Please and Thank You." (Comp., p. 5). Plaintiff is also dissatisfied with the PREA investigation into his complaints. Plaintiff has filed a motion for a preliminary injunction (PI) #5 and a motion for a temporary restraining order (TRO) #6 with his complaint. Plaintiff says simply that he needs injunctive relief because the PREA report was found to be unsubstantiated. For either a TRO or PI, Plaintiff must demonstrate: 1) his underlying case has some likelihood of success on the merits; 2) no adequate remedy at law exists; and 3) he will suffer irreparable harm without the relief. Merritte v. Kessel, 561 F. App'x 546, 548 (7th Cir. 2014) (citing Woods v. Buss, 496 F.3d 620, 622 (7th Cir. 2007). Plaintiff cannot meet his burden and the motions for injunctive relief are denied #5 , #6 . Plaintiff will receive a copy of the Court's order once it reviews the Plaintiff's complaint pursuant to 28 U.S.C. 1915A. (SAG, ilcd)
