July 15, 2019 Opinion or Order TEXT ORDER: The Plaintiffs' Motion to Reconsider 7/12/2019 Order Granting Defendant Schneider's Motion for a More Definite Statement - Due to Lack of Notice #13 is GRANTED. The 6/27/2019 Certificate of Service attached to Defendant Schneiders Motion for a More Definite Statement Pursuant to FRCP Rule 12(e) #5 provides "this instrument will be served on the parties of record via the electronic filing system. Schneider filed its Motion on 6/27/2019 before Plaintiffs' counsel had entered their appearances and therefore, the Plaintiffs' counsel were not yet receiving electronic filings in this case. It remained Defendant Schneider's responsibility to properly serve the Plaintiffs pursuant to the relevant Federal Rules of Civil Procedure and Local Rules. Fed. R. Civ. P. 12(e) provides in relevant part, "A party may move for a more definite statement of a pleading to which a responsive pleading is allowed but which is so vague or ambiguous that the party cannot reasonably prepare a response." Motions for a more definite statement are "generally disfavored, and courts should grant such motions only if the complaint is so unintelligible that the defendant cannot draft a responsive pleading." Moore v. Fid. Fin. Servs., Inc., 869 F. Supp. 557, 559-60 (N.D. Ill. 1994). Furthermore, "Rule 12(e) motions should not be used as a substitute for the normal discovery process." Mollet v. St. Joseph's Hosp. Breese, No. 16-cv-0293, 2017 WL 1035750, at *3 (S.D. Ill. Mar. 17, 2017), quoting Metso Paper, Inc. v. Enerquin Air, Inc., No. 06-C-1170, 2007 WL 486635, at *5 (E.D. Wis. Feb. 12, 2007). As the Plaintiffs argue, Defendant Schneider's Motion is premature where discovery has not yet commenced. Moreover, the Complaint's allegations against Defendant Schneider are not so vague as to render them unintelligible. See Gardunio v. Town of Cicero, 674 F. Supp. 2d 976, 992 (N.D. Ill. 2009) ("Rule 12(e) is designed to strike at unintelligibility rather than want of detail").
