The Plaintiff's Motion to Proceed in forma pauperis was submitted under penalty of perjury and sufficiently demonstrates that the Plaintiff should be excused from paying the filing fee in this action. It is ordered that the Clerk issue summons, and the United States Marshal serve a copy of the Complaint, summons, and this Text Order upon the Defendant in accordance with Federal Rule of Civil Procedure 4(i). All costs of service shall be advanced by the United States. (WG, ilcd) |

TEXT ORDER by Magistrate Judge Jonathan E. Hawley: The Court has reviewed Plaintiff's #2 Motion for Leave to Proceed in forma pauperis. The Plaintiff's Motion to Proceed in forma pauperis was submitted under penalty of perjury and is insufficient for the Court to determine Plaintiff's ability to pay the filing fee as the completion is vague due to minimal details. Plaintiff must either pay the filing fee or refile Form AO 239, under penalty of perjury by 12/2/2019. Entered on 10/30/2019. (WG, ilcd) |
Chief Judge Sara Darrow added. Judge James E. Shadid no longer assigned to case. (RK, ilcd) |
TEXT ORDER: The Plaintiff's Complaint #1 states that the Plaintiff is a resident of Knox County, Illinois. Knox County, Illinois is in the Central District of Illinois, and thus the Plaintiff correctly filed in this district pursuant to 20 C.F.R. 422.210(b). However, the Plaintiff filed this case in the Peoria Division of the U.S. District Court for the Central District of Illinois. Local Rule 40.1(C) provides that "All complaints and subsequent filings in cases which arise from the following counties:... Knox... will be filed at ROCK ISLAND, ILLINOIS." The Clerk is therefore directed to TRANSFER this case to the Rock Island Division of the U.S. District Court for the Central District of Illinois. Entered by Magistrate Judge Jonathan E.
