TEXT ORDER: The Plaintiff filed this action in the Sixth Judicial Circuit, Champaign County, Illinois. The Defendant filed a Notice of Removal #1 in the Central District of Illinois, Peoria Division. 28 U.S.C. Section 1446(a) provides: "A defendant or defendants desiring to remove any civil action from a State court shall file in the district court of the United States for the district and division within which such action is pending...." Because Champaign County is located within the Urbana Division (see Local Rule 40.1(D)), the Clerk is directed to TRANSFER this case to the Urbana Division of the United States District Court for the Central District of Illinois.
