Filing 14 ORDER entered by Judge Colin Stirling Bruce on 12/16/2019. Defendants have twenty-one (21) days from the date of this Order to file a motion to dismiss under Federal Rule of Civil Procedure 12(b)(6) if they believe that such a motion is warranted. If Defendants do not file a motion to dismiss, the Court will conduct a merit review of Plaintiff's Complaint at the expiration of this twenty-one (21) day period, and the case will proceed accordingly, assuming that the Court finds that Plaintiff's Complaint states a claim upon which relief can be granted. In light of this Order, Defendants' Rule 81 motion #10 is DENIED as moot. Defendants may re-file their service arguments raised therein if they decide to file a Rule 12(b)(6) motion to dismiss. Plaintiff has twenty-one (21) from the date of this Order to file a motion to remand this case to state court under 28 U.S.C. Sec 1447(c), if he believes that a remand is justified and that is the strategy that he wants to employ. If Plaintiff does not timely file a motion to remand, and if Defendants do not timely file a motion to dismiss, the Court will conduct the merit review required by 28 U.S.C. Sec 1915A.
