TEXT ONLY ORDER: On January 10, 2020, a Text Order incorrectly identified Magistrate Judge Hawley as issuing the Order, when in fact it was issued by Judge Shadid. The Court adopts the previous ruling dismissing Plaintiff's Complaint #1 and denying Plaintiff's Motions #2 , #3 , #6 , and #7 . Additionally, a copy of the previous Text Order was conventionally mailed to Plaintiff and returned as undeliverable. Plaintiff is reminded to follow Local Rule 16.3(K), which states every pro se plaintiff must notify the Clerk in writing of any change of address. Failure to notify the Clerk of a change of address will result in the dismissal of the case. The Court sua sponte extends Plaintiff's deadline to file an amended complaint by February 18, 2020. TEXT ONLY ORDER entered by Magistrate Judge Jonathan E. Hawley on 1/10/2020. Plaintiff filed a Motion #2 for Leave to Proceed in forma pauperis, which requires the Court to screen the case before granting the privilege to proceed without prepayment of fees pursuant to United States v. Durham, 922 F.3d 845, 846 (7th Cir. 2019). The law provides such case must be dismissed if, in relevant part, it "s frivolous or malicious" or "fails to state a claim on which relief may be granted". 28 U.S.C. 1915(e)(2)(B). The Court finds Plaintiffs Complaint is indecipherable. Plaintiff's Motion #2 is denied without prejudice. Plaintiff's Complaint is dismissed without prejudice. Additionally, it does not appear that any named party is located in this District and no alleged claim occurred here. The Court must dismiss or transfer any case filed in the wrong division or district pursuant to 28 U.S.C. 1406. Plaintiff must pay the filing fee and file an amended complaint by February 7, 2020, or in the alternative, file a new petition to proceed in forma pauperis with an amended complaint. The amended complaint must state a claim on which relief may be granted. If it does not do so, this case will be dismissed. Plaintiff's Motions #3 to Request Counsel and #6 for Evidentiary Hearing are denied without prejudice. Plaintiff's Motion #7 to Seal All Documents from Public is denied because Plaintiff has provided no basis to seal anything in this case at this time.(RK, ilcd) |
