IT IS THEREFORE ORDERED that Plaintiff Wayne Patterson II's 2016 Fourth Amendment claim against the individual officers and his equal protection claim(s) against the individual officers and municipality shall proceed. Plaintiff Wayne Patterson IIs 2019 Fourth Amendment Claim is DISMISSED WITHOUT PREJUDICE. Plaintiff Wayne Patterson I's 2019 Fourth Amendment Claim and Fourteenth Amendment Claim are DISMISSED WITHOUT PREJUDICE. Either Plaintiff may file an amended complaint within twenty-one (21) days of the date of this Order if he is able to cure the identified factual deficiencies with his claim. Both Plaintiffs are reminded that in repleading, they must adhere to the standards of Federal Rule of Civil Procedure 11. All other claims are DISMISSED WITH PREJUDICE. Plaintiff Wayne Patterson is terminated from this case. The Clerk is directed to serve the Defendants. Just because no other deficiencies warranting dismissal are apparent does not mean there may not be other grounds for dismissal less evident; Defendants may file a Motion to Dismiss per Rule 12(b)(6) if they identify a deficiency with the remaining claims.
