March 18, 2020 Opinion or Order TEXT ORDER granting #3 Plaintiff's Second Motion for Leave to Proceed in forma pauperis. On March 4, 2020, the Court denied #2 Plaintiff's Motion for Leave to Proceed in forma pauperis because it was incomplete, and granted him leave to refile a new application. The federal in forma pauperis statute, 28 U.S.C. 1915, is designed to ensure that indigent litigants have meaningful access to the federal courts. Neitzke v. Williams, 490 U.S. 319, 324 (1989). As a result, it allows an indigent party to commence an action in federal court, without costs and fees, upon submission of an affidavit asserting an inability "to pay such costs or give security therefor" and stating "the nature of the action, defense or appeal and the affiant's belief that he is entitled to redress." 1915(a). In support of his recent application, Plaintiff states, under penalty of perjury, that he is unemployed and receives $783.00 a month in social security benefits with $770.00 in monthly expenses. Plaintiff has no other income. Accordingly, the Court finds that Plaintiff lacks sufficient funds to prepay the filing fee, and therefore GRANTS #3 Plaintiff's Second Motion for Leave to Proceed in forma pauperis. The United States Marshal is directed to serve a copy of the #1 Complaint, Summons, and this Order upon the Defendants. See 28 U.S.C. 1915(d). All costs of service shall be advanced by the United States.Entered by Judge Michael M. Mihm on 3/18/2020. (NRL, ilcd)
March 16, 2020 Filing 3 MOTION for Leave to Proceed in forma pauperis by Plaintiff Aries Sinclair. Responses due by 3/30/2020 (Attachments: #1 Motion IFP Short Form)(VH, ilcd)
March 5, 2020 Set Deadline: Miscellaneous Deadline 3/25/2020 for Plaintiff to file IFP (VH, ilcd)
March 4, 2020 Opinion or Order TEXT ORDER: Plaintiff's #2 Motion for Leave to Proceed in forma pauperis is DENIED with leave to re-file. Plaintiff's application is incomplete as he has failed to answer question seven regarding any dependents and question eight regarding debts or financial obligations. Accordingly, the Court is unable to determine at this time whether Plaintiff qualifies as an indigent litigant under 28 U.S.C. 1915. Plaintiff may file a new application to proceed in forma pauperis within twenty-one (21) days of this Order or pay the filing fee. Plaintiff's failure to return a completed application to proceed in forma pauperis or pay the filing fee within this time frame will result in the Court dismissing this case. Entered by Judge Michael M. Mihm on 3/4/2020. (NRL, ilcd)
March 2, 2020 Filing 2 MOTION for Leave to Proceed in forma pauperis by Plaintiff Aries Sinclair. Responses due by 3/16/2020 (JRK, ilcd)
