TEXT ORDER granting #10 Motion for Leave to Proceed in forma pauperis entered by Judge Colin Stirling Bruce on 4/29/2020. Plaintiff's trust fund ledgers indicate he has no funds to make an initial partial payment of the filing fee. Pursuant to 28 U.S.C. Section 1915(b) (4), the initial partial filing fee is waived. The agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office. (KE, ilcd) |

Filing 9 TEXT ORDER entered by Judge Colin Stirling Bruce on 4/20/2020. On March 23, 2020, the Court mailed Plaintiff a notice of case opening to his listed address, the Tazewell County Justice Center. The next day, the Court sent Plaintiff an Order, directing him to either pay the $400 filing fee or submit a properly completed petition to proceed in forma pauperis. On March 31, 2020, both mailings were returned to the Clerk of the Court as undeliverable #5 . Plaintiff has since filed a motion that updates his address, requests the recruitment of counsel, and requests the status of his case #7 . The Court directs the Clerk to send this Order and the proper form to request in forma pauperis status to Plaintiff at Illinois River Correctional Center. The Court Orders Plaintiff to either pay the $400 filing fee or complete and submit the provided form by May 4, 2020. Plaintiff's failure to timely comply will result in dismissal of his suit. Accordingly, the Court DENIES Plaintiff's motion to proceed in forma pauperis #3 with leave to renew. The Court admonishes Plaintiff that if the Court grants his renewed petition to proceed in forma pauperis, Plaintiff will remain responsible for paying the entire $350 reduced filing fee in installments regardless of the outcome of his case. If Plaintiff does not want to pursue his claim, he should file a motion to dismiss. The Court DENIES Plaintiff's motion for recruitment of counsel #7 because Plaintiff has not demonstrated that he attempted to hire counsel, which typically requires writing to several lawyers and attaching the responses received. See Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007) (concluding that before the Court can consider a plaintiff's motion for counsel, the Court must ask two questions: "(1) has the indigent plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself"). With the entry of this Order, Plaintiff's motion for status #7 is MOOT. (KE, ilcd) |
