CASE MANAGEMENT ORDER entered by Judge James E. Shadid on 6/25/2020. IT IS THEREFORE ORDERED: 1) Plaintiff's motion is denied for the reasons stated in this order. See Matthews v. Culkin, Case No. 19-1327 16 and Matthews v. Prentice, 20-1176. #8 . 2) The Clerk of the Court is to file this order in both Matthews v. Culkin, Case No. 19-1327 and Matthews v. Prentice, 20-1176. 3) In Matthews v. Culkin, Case No. 19-1327, a Scheduling Order will be entered once the Defendants file an answer to the complaint. The order will set specific, discovery deadlines. Plaintiff should then renew his request for his legal reference books at his current facility with a copy of both the Scheduling Order and this order. 4) In Matthews v. Prentice, 20-1176, the Clerk of the Court is directed to send Notice of Lawsuit and Service of Process documents to the named Defendants and set an internal, Rule 16 hearing deadline. 5) The Plaintiff is reminded he must immediately notify the Court in writing of any change in his mailing address or phone number. Failure to provide this information could lead to the dismissal of his lawsuit. 6) Plaintiff should include a specific case number on any document he files to indicate which case it should be filed in. The Clerk of the Court is to provide Plaintiff with a copy of the docket sheet in each case to assist him. TEXT ORDER granting #5 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $.62. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. IT IS ORDERED: 5) Sever Plaintiff's claim alleging Defendants Prentice, Thornsome, Sorenson, Drysdale, and Melvin violated Plaintiffs Eighth Amendment rights based on Plaintiff's living conditions from February of 2017 to at least February of 2018 into a separate lawsuit with a separate case number. Plaintiff will have 21 days to either pay the $400 filing fee in full or file a motion to proceed in forma pauperis. The Clerk should also file a copy of this order in the new case.
