Filing 6 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 5/19/2020. Plaintiff's motion for a preliminary injunction #5 is DENIED. Plaintiff's motion for leave to proceed in forma pauperis #3 is GRANTED, and the Clerk of the Court is directed to calculate the amount of the initial, partial filing fee (if any) that the Court should impose upon Plaintiff in order to litigate this case. Pursuant to its merit review of the Complaint under 28 U.S.C. Sec 1915A, the Court finds that Plaintiff's Complaint states three claims: (1) a retaliation claim in violation of his First Amendment rights against Defendants based upon his allegations that Defendant Smith has threatened to kill him if he does not dismiss another lawsuit that Taylor had filed and based upon his allegations that the other Defendants (including the John Doe Defendant) will not assist him (either by protecting him from Smith or obtaining medical attention for him) because he has filed the other lawsuit ; (2) a failure to intervene or protect claim against Defendants Warden Jackson, Lt. Hart, Lt. Pratt, Sgt. Bailey; and John Doe; and (3) a deliberate indifference claim to his serious medical needs against all Defendants (including the John Doe Defendant) in violation of his Eighth Amendment rights. Any additional claims shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The Clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. The Clerk is directed to attempt service on all Defendants pursuant to the Court's standard procedures. See written order. (KE, ilcd) |
TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 5/19/2020. Plaintiff`s trust fund ledgers indicate he has no funds to make an initial partial payment of the filing fee. Pursuant to 28 U.S.C. Section 1915(b)(4), the initial partial filing fee is waived. The agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office. (KE, ilcd) |
