August 13, 2020 Opinion or Order TEXT ORDER: On August 12, 2020, the parties filed a #29 Joint Stipulation of Dismissal signed by both parties. Under Federal Rule of Civil Procedure 41(a) (1) (A) (ii), the plaintiff may dismiss an action without a court order by filing a stipulation of dismissal signed by all parties who have appeared. However, within the stipulation itself, parties stipulate to dismissal without prejudice for 21 days and further stipulate that if no motion to reinstate is filed on or before 9/2/2020, the dismissal will automatically convert to one WITH PREJUDICE. Accordingly, Plaintiff's action is DISMISSED WITHOUT PREJUDICE at this time. If a motion to reinstate the case is not filed by or before 9/2/2020, the dismissal will be automatically to converted to one WITH PREJUDICE. In light of the dismissal, Plaintiff's #3 Motion for Preliminary Injunction, Defendants' #28 Motion for to Dismiss the Complaint, and hearing on Plaintiff's Preliminary Injunction scheduled for 8/19/2020 are all vacated. July 8, 2020 Opinion or Order TEXT ONLY ORDER granting Plaintiff's Motion #5 to Expedite Discovery. The parties are permitted to engage in limited discovery in preparation for the hearing on Plaintiff's Motion for Preliminary Injunction as follows: 1. Issuance of up to 20 interrogatories by each party related to Plaintiff's Motion for Preliminary Injunction, required to be promulgated within 7 days of the date of the Court's order, for response within 14 days or 5 days prior to the hearing on Plaintiff's Motion for Preliminary Injunction, whichever is sooner. The Court defers ruling at this time as to whether these interrogatories will count towards the 25 interrogatory limit in Rule 33(a)(1). 2. Issuance of up to 25 requests for production by each party related to Plaintiff's Motion for Preliminary Injunction, required to be promulgated within 7 days of the date of the Court's order for response within 14 days or 5 days prior to the hearing on Plaintiff's Motion for Preliminary Injunction, whichever is sooner. 3.
