TEXT ORDER Entered by Judge Michael M. Mihm on 9/2/20: Pursuant to the Text Order the Court entered on 8/25/2020, the Clerk of Court sent Plaintiff blank summonses to complete and return. Plaintiff completed and returned a summons that was incorrectly addressed to both Defendants as " Rachel Pace dba Illinois Central College." This summons is defective and cannot be issued. Therefore, the Clerk is directed to send Plaintiff two additional blank summonses. Plaintiff is directed to address one summons to Defendant Rachel Pace and the other summons to Defendant Illinois Central College and to return the summonses to the Clerk. Upon receipt, the Clerk is to then issue the summonses and the USMS is ordered is to serve the summonses on the Defendants. (TK, ilcd) |

TEXT ORDER: GRANTING Plaintiffs renewed #3 Motion for Leave to Proceed in forma pauperis. In reviewing a motion for leave to proceed in forma pauperis, the Court must make two determinations. First, the Court must determine whether Plaintiff is unable to pay the filing fee associated with the case. If Plaintiff is unable to pay the filing fee, the Court must then determine if the complaint is frivolous or malicious. The Plaintiffs Motion to Proceed in forma pauperis was submitted under penalty of perjury and sufficiently demonstrates that the Plaintiff should be excused from paying the filing fee in this action. The Court is also obligated to give the Plaintiffs pro se pleadings a liberal construction and finds the Complaint is neither frivolous nor malicious. See Haines v. Kerner, 404 U.S. 519, 520-21 (1972). Accordingly, Plaintiffs renewed #3 Motion for Leave to Proceed in forma pauperis is GRANTED. Entered by Judge Michael M. Mihm on 8/24/2020. (KH1, ilcd) |

TEXT ORDER: DENYING Plaintiff's #2 Motion for Leave to Proceed in forma pauperis. In reviewing a motion for leave to proceed in forma pauperis, the Court must make two determinations (1) whether Plaintiff is unable to pay the filing fee associated with the case and (2) whether the complaint is frivolous or malicious. In regard to whether Plaintiff is able to pay the filing fee associated with the case, the #2 Motion for Leave to Proceed in forma pauperis, is not signed by the Plaintiff, and therefore does not fulfill the affidavit of poverty requirement of the in forma pauperis statute. 28 U.S.C.A. 1915(a). As a result, the Court DENIES Plaintiff's #2 Motion for Leave to Proceed in forma pauperis WITHOUT PREJUDICE and allows him twenty-one (21) days to refile an application in accordance with 28 U.S.C.A. 1915.
