September 11, 2020 Opinion or Order Filing 3 ORDER entered by Judge James E. Shadid on 9/11/2020. IT IS THEREFORE ORDERED:(1) Respondent shall file an answer, motion, or other response, within twenty-one (21) days after service of this Order. (2) After Respondent has filed its response, Petitioner shall file any traverse or reply to Respondents response within twenty-one (21) days after service of said response on him. The Court admonishes Petitioner that a failure to reply to the response pursuant to 28U.S.C. 2248 will cause the Court to take the allegations in the response to the Writ of habeas corpus as true except to the extent that the judge finds from the evidence that they are not true. (3) Petitioner shall serve upon Respondent, or, if appearance has been entered by counsel, upon its attorney, a copy of every further pleading or other document submitted for consideration by the Court. Petitioner shall include with the original paper to be filed with the Clerk of the Court a certificate stating the date that a true and correct copy of any document was mailed to Respondent or its counsel. Any paper received by this Court that has not been filed with the Clerk or that fails to include a certificate of service will be disregarded by the Court. (4) Petitioner is shall immediately notify the Court of any change in his mailing address. Failure to notify the Court of any change in mailing address will result in dismissal of this lawsuit, with prejudice. (5) The Clerk is DIRECTED to substitute the Warden of FCI Pekin for Respondent United States. (6) Petitioner's Motion for an Order Preventing a Transfer (d/e #2 ) is DENIED. SEE FULL WRITTEN ORDER. August 24, 2020 Opinion or Order TEXT ORDER: Petitioner has filed a Petition for Habeas Corpus Pursuant to 28 U.S.C. 2241. Petitioner is directed to either pay the $5 filing fee or provide the Court with a signed Application to Proceed in District Court Without Prepaying Fees or Costs that also includes a copy of his trust fund ledger, certified by the appropriate institutional officer, showing all receipts, expenditures and balances for the last six months. Petitioner shall do so on or before September 14, 2020, or the Court will dismiss the case without prejudice for failure to pay the filing fee.
