TEXT ORDER denying #3 Motion for Leave to Proceed in forma pauperis entered by Judge Joe Billy McDade on 9/15/2020. A civil proceeding may proceed without prepayment of fees upon a proper showing the plaintiff is unable to pay such fees or give security therefor. 28 U.S.C. 1915(a)(1). In support of her Petition, Plaintiff states, under penalty of perjury, she has received no income in the past twelve months but her spouse earns approximately $3,400 per month, which covers substantially all the couple's monthly expenses; additionally, her spouse has $11,000 in a savings account, and the couple owns, inter alia, a home, other real estate, and two motor vehicles. Further, Plaintiff has retained private counsel. Based on Plaintiff's affidavit, the Court cannot make the requisite finding Plaintiff is unable to pay the applicable filing fee. Plaintiff's Petition for Leave to Proceed in forma pauperis is therefore denied. Plaintiff shall pay the applicable filing fee within 28 days; failure to do so may result in dismissal for want of prosecution. (EWL, ilcd) |
