TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Sue E. Myerscough on 12/14/2020. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $28.33. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. Plaintiff is ultimately responsible for ensuring that the initial partial filing fee and required monthly payments are made. Failure to do so may result in dismissal of this case. TEXT ORDER entered by Judge Sue E. Myerscough on 11/9/2020. Plaintiff has sent a letter from his detention in the Tazewell County Jail, alleging unspecified systemic civil rights violations of detainees, including himself. Plaintiff also alleges that his criminal case was "ill represented" through false witness statements and false police reports. Plaintiff asks for advice and help with the situation. Generally, a federal court decides disputes between parties regarding federal law. The court waits for a lawsuit to be filed and then rules on the disputes between the plaintiff and the defendants. A federal court does not initiate investigations or advocate on a person's behalf. Additionally, challenges to Plaintiff's criminal case must be made in that case and through appeals in state court before turning to federal court. If Plaintiff intends to pursue a federal lawsuit at this time, he must pay the $400 filing fee, either in full or through installments from his prison account. 28 U.S.C. Sec 1915(b)(1). Additionally, Plaintiff must first pursue the grievance procedure at the jail, including any available appeals, before filing a lawsuit in federal court. 42 U.S.C. Section 1997e(a). If Plaintiff intends to pursue a lawsuit, then by December 14, 2020, Plaintiff is directed to file a complaint and either pay the $400 filing fee or file a petition to proceed in forma pauperis to pay the filing fee in installments. If Plaintiff does not do so, the Court will assume that Plaintiff did not intend to pursue a lawsuit at this time and will dismiss this case without prejudice to refiling and without assessing a filing fee.
