The Court has received a letter from Shauntez Winters inquiring about a complaint that he filed with this Court, under 42 USC Section 1983, against McLean County Sheriff Jon Sandage in late August 2020. The Court has no record of ever receiving Winters' complaint, and the Court has no record of Winters ever filing any other lawsuit(s) in this Court. Out of an abundance of caution and in order to avoid any potential statute of limitations problems that Winters may encounter, the Court has opened a case based upon his letter to the Court. However, because that letter is insufficient to state a claim upon which relief can be granted, Winters must file an amended complaint. In addition, the Court has no record of Winters either moving for leave to proceed in forma pauperis in this case or paying the required filing fee. Accordingly, the Clerk of the Court is directed to send the forms necessary to Winters for him to amend his complaint and to seek leave to proceed in forma pauperis, if that is his desire to do so. Winters is strongly encouraged to use these forms if he wants to proceed in this case, and he should reference this case number if he wants to proceed. Winters should complete and return these forms to the Court within twenty-eight (28) days from the date of this order. If Winters does not timely comply with this order, the Court will interpret his silence as indicating that he does not wish to proceed with this case, and the Court will close this matter.
