TEXT ONLY ORDER: granting Plaintiff's Motion #3 for Reconsideration re the Court's 2/1/21 Text Order. After conferring with the Clerk's office, the Court has determined that although the docket did not reflect it, Plaintiff did indeed pay the $402 filing fee in this case on 1/21/2021. The Court apologizes for any inconvenience this oversight may have caused Plaintiff. Therefore, the Court's 2/1/2021 Order is vacated, and this case is reinstated. Additionally, the Clerk is directed to forward Plaintiff a blank copy of the summons. Plaintiff must fill out the summons and return it to the Clerk for issuance. Fed. R. Civ. P. 4(b). Plaintiff is reminded that he is responsible for having the summons and complaint served upon the Defendants within the time allowed by Rule 4(m) of the Federal Rules of Civil Procedure. See Fed. R. Civ. P. 4(c). Alternatively, Plaintiff may send a letter to the Defendants requesting that Defendants waive service of summons. See Fed. R. Civ. P. 4(d)(1). The Clerk is directed to forward Plaintiff a blank copy of the notice of lawsuit and request for waiver of service form. To date, Plaintiff has failed to pay the fee or file an IFP petition. The Court further notes Plaintiff has previously filed a case in the Central District of Illinois that was dismissed for failure to prosecute. See Bradford v. City of Eureka Illinois et al., No. 1:20-cv-01274 (C.D. Ill. 2020). Therefore, the Court dismisses this case with prejudice. Fed. Civ. P. 41(b). The Clerk is directed to close this case.
