March 25, 2021 Opinion or Order Filing 8 MERIT REVIEW AND CASE MANAGEMENT ORDER Entered by Judge Harold A. Baker on 3/25/2021. It is therefore ordered: 1. Pursuant to its merit review of the Complaint under 28 U.S.C. 1915A, the court finds that the plaintiff states a claim under the Religious Land Use and Institutionalized Persons Act, 42U.S.C. 2000cc1(a), and the First Amendment's free exercise clause against Defendants John Doe, Herber, and Cox. Any additional claims shall not be included in the case, except at the court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. 2. This case is now in the process of service. 3. The court will attempt service on the defendants by mailing each defendant a waiver of service. 4. The clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. 5. The clerk is directed to terminate Pontiac Correctional Center as a defendant. 6. The clerk is directed to attempt service on Defendants Herber and Cox pursuant to the standard procedures. 7. Plaintiff's motion for extension of time and motion of verification #6 #7 are denied as moot. The Court received Plaintiff's payment of $402.00 on March 16, 2021. 8. Plaintiff's motion for counsel #5 is denied, with leave to renew upon demonstrating that he made attempts to hire his own counsel. SEE WRITTEN ORDER. (KB)

March 4, 2021 Opinion or Order TEXT ORDER Entered by Judge Harold A. Baker on 3/4/21. Plaintiff filed a Petition to Proceed in forma pauperis #3 . His trust fund ledgers disclose that Plaintiff received approximately $1900.00 in income since September 2020. (Doc. 4). Plaintiff spent approximately $1300.00 at commissary and other places in the month preceding the date he filed this case, and he currently has a balance of $507.49. The Court finds that Plaintiff is not indigent and that he is capable of paying the $402.00 filing fee in this case. Plaintiff's Petition to Proceed in forma pauperis #3 is DENIED. See Lumbert v. Ill. Dep't of Corrs., 827 F.2d 257, 260 (7th Cir. 1987) (a litigant who "thinks that a more worthwhile use of his funds would be to buy [commissary items] than to file a civil rights suit has demonstrated an implied evaluation of the suit that the district court is entitled to honor."). Plaintiff shall pay the $402.00 filing fee in full within 21 days of this Order. Failure to do so will result in dismissal of this case without prejudice. (KB)
