TEXT ORDER entered by Judge Colin Stirling Bruce on 6/9/2021. On April 30, 2021, Plaintiff filed this suit under 42 USC Section 1983, alleging a violation of his Constitutional rights. In filing this lawsuit, Plaintiff neither paid the required filing fee, nor did he move for leave to proceed in forma pauperis. On May 3, 2021, the Court ordered Plaintiff either to pay the filing fee or to move for leave to proceed IFP. The Court gave Plaintiff twenty-one (21) days to complete one of these tasks. On May 20, 2021, the Court received its order returned to it as undeliverable. Accordingly, on May 24, 2021, the Court gave Plaintiff fourteen (14) days within which to file a change of address, in writing, with the Court. As of today, Plaintiff has not provided his current address as ordered by the Court. Local Rule 16.3(K) requires every pro se plaintiff to inform the Court of any change of address that occurs during the pendency of his case. Failure to comply with this Local Rule results in the dismissal of the case. Id. Plaintiff has failed to comply with the Court's Orders and with the Court's Local Rules, in that, he has not paid the required filing fee or moved to proceed IFP, and he has not kept the Court informed of his current address as ordered by the Court and as required by Local Rule 16.3(K). As a result, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to comply with Local Rule 16.3(K) and with the Court's Orders. No judgment to enter. (KE) |
