Plaintiff's motion for leave to proceed in forma pauperis #3 is DENIED because Plaintiff had the funds necessary to pay the filing fee in full when he filed this case. In order to litigate this case, Plaintiff must pay the $402.00 filing fee in full. Plaintiff must pay the entire filing fee within twenty-one (21) days from the date of this Order. If Plaintiff fails to pay the filing fee in full by that date, the Court will dismiss this case. After Plaintiff timely pays the filing fee in full, the Court will conduct a merit review of his Complaint that is required by 28 U.S.C. Sec 1915A. See written order. (KE) |

The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after the Court conducts a merit review of the complaint. Plaintiff may renew his motion if his claim survives a merit review that the Court will conduct in the near future. (KE) |
TEXT ORDER entered by Judge Colin Stirling Bruce on 5/17/2021. Plaintiff's motion for appointment of expert #6 is DENIED. Initially, Plaintiff's motion for an expert is denied as premature. The Court has not yet conducted a merit review of Plaintiff's Complaint to determine if it states a claim upon which relief can be granted. Therefore, it is not known whether an expert is necessary to prove any claim or to assist the jury in this case. In addition, discovery has not yet commenced. Therefore, a request for an expert is premature. Finally, Plaintiff does not seek an independent, court-appointed expert. Rather, Plaintiff wants the Court to find an expert to support Plaintiff's claims at the Court's expense. There is no provision in the United States Code or the Federal Rules of Civil Procedure for such an appointment. Tolonen v. Heidorn, 2013 WL 5276126, * 1 (W.D. Wis. Sept. 18, 2013). Accordingly, Plaintiff's motion is denied. Plaintiff may renew his motion, if necessary, during the discovery period. (KE) |
